Key Definitions:

 

  1. Inventalator”, “Ideawake”, “we”, “us”, and “our” means Inventalator, Inc. and its subsidiaries, agents, employees, and representatives.
  2. Personal Data” means any information relating to an identified or identifiable natural person (Users).
  3. For purposes of this Policy, “processing” means collecting, recording, organizing, structuring, storing, adapting, altering, using, disclosing, or otherwise making available, and deleting Personal Data provided to us through the Site or Software.
  4. Site” or “Website” means ideawake.com, and any related mobile applications.
  5. Software” means any software of platform developed by us and accessed through the Site or Website.

Users provide Ideawake with most of the Personal Data we collect. We collect the following types of data:

 

  1. Personal Identification Information You Give Us: We collect Personal Data such as your‎ name,‎ email address,‎ username,‎ password,‎ demographic information (such as your gender and occupation), and other information you directly give us through the Site or Software.
  2. Information We Get from Others: We may collect information gathered from third-party sites or sources you accessed, such as Facebook, Google, or Twitter. Any third-party information may be combined with the information received directly from you. Some third-party sites or sources may also provide us with information from your accounts to enhance and personalize your use of our Site. You have the right to modify your privacy settings on your device, browser, or on the third-party sites and right to refuse to provide certain information or receive interest-based advertisements on those third-party sites directly on the respective third-party site.

C. How We Will Use Your Personal Data

Personal Data submitted to us through our Site will be used for the purposes specified in this policy or as provided for on the Site. Ideawake collects the Personal Data of Users so that we can:

  2. Personalize User experience: Information is used in the aggregate to understand how our Users as a group use the services and resources provided on our Site.

  4. Process order and payment: Information Users provide about themselves when placing an order is used only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
  5. Run a promotion, contest, survey, or other Site feature: To send Users information they agreed to receive about topics we think will be of interest to them.

Send periodic emails: We use the email address to send User information and updates pertaining to their continuous improvement tools It is also used to respond to their inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product, or service information, etc. A User may unsubscribe from such emails at any time. If the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.

Other: We may use Personal Data in other ways to fulfill any purpose for which you provide us with the Personal, for any other purpose with your consent, or in any other way we may describe when you provide the information, including to carry out our obligations and enforce rights that may arise from any contracts entered between you and us.

The Site reserves the right to share any Personal Data you post on the Site with third parties with your prior consent. To the extent the Site does so, the subsequent use and disclosure of such information is subject to the privacy policies and practices of those third parties.

 

Disclosing Personal Data

We disclose your Personal Data to any of our employees, officers, insurers, professional advisers, agents, suppliers, or subcontractors as reasonably necessary for the purposes set out in this policy and our Terms of Use. We also disclose your Personal Data to any member of our companies (including any of our subsidiaries, holding companies and all its subsidiaries) as reasonably necessary for the purposes set out in this policy and our Terms of Use and Disclaimer.

 

Choices About Use and Disclosure of Your Personal Data

When you visit or use our Site or Software, you have choices regarding the Personal Data you provide to us.

If we have already sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to us as a result of a product purchase, Software purchase, or other transactions with us.

D. How We Store and Retain Your Data

Our data retention policies and procedures are designed to ensure that we comply with our legal obligations regarding the retention and deletion of Personal Data in accordance with all applicable state, federal, and international laws and regulations.

 

Ideawake does not keep any Personal Data for longer than is necessary to carry out the purpose or purposes for which the Personal Data was collected. At most, Inventalator will keep Personal Data for a period of up to 3 years. Users may request Inventalator to delete their Personal Data or request an accounting of all Personal Data of theirs kept by Inventalator by sending an email to [email protected] or completing this Data Subject Request Form. Inventalator will respond within five (5) business days to any such requests. Notwithstanding the other provisions of this Section D, we will retain documents (including electronic documents) containing Personal Data:

 

  1. To the extent that we are required to do so by law;
  2. If we believe that the documents may be relevant to any ongoing or prospective legal proceedings; and/or
  3. To establish, exercise, or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).

 

E. Security Measures

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. Sensitive and Personal Data exchange between the Site and its Users happens over an SSL secured communication channel and is encrypted and protected with digital signatures. You are responsible for keeping the password you use for accessing our Site and Software confidential.

 

You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

 

If a data breach occurs: If we determine that any User’s Personal Data has been accessed without authorization, Inventalator will report any confirmed or suspected situation to necessary parties immediately upon discovery, both orally and in writing, within 72 hours. If Inventalator reasonably believes a breach has or may have occurred, Inventalator will release a report to all Users identifying:

 

  1. The nature of the unauthorized access, use, or disclosure;
  2. The nonpublic information accessed, used or disclosed;
  3. The person(s) who accessed, used, disclosed, and/or received nonpublic information (if known);
  4. What Inventalator has done or will do to mitigate any deleterious effect of the unauthorized access, use, or disclosure; and
  5. What corrective action Inventalator has taken or will take to prevent future unauthorized access, use, or disclosure.

 

In the event of a suspected Breach, Inventalator will keep stakeholders informed regularly of the progress of its investigation until the uncertainty is resolved. To the extent possible, we will also facilitate the process to warn the victims of the theft so that they can protect their identity.  

 

F. International Data Transfers

 

The Site is hosted in the United States, and all or a portion of the Site may also be hosted on the “cloud”, or other similar distributed hosting platform. If you are accessing the Site or Software from the European Union, Asia, or any other region with laws governing Personal Data collection, use, and disclosure that differ from United States laws, note that you are transferring your Personal Data to a jurisdiction that does not have the same data protection laws as your home jurisdiction. By providing your Personal Data you consent to:

 

  1. our use of your Personal Data for the uses identified in this Privacy Policy, and
  2. the transfer of your Personal Data to the United States.

 

Under the General Data Protection Regulation (GDPR), if you have provided consent for the processing of your personal information, you have the right to withdraw consent at any time, which will not affect the lawfulness of the processing before your consent was withdrawn. You have the right to request access to and rectification or erasure of your personal information, as well as the right to restrict processing, object to processing, and under certain circumstances the right to data portability. Inventalator will be completely transparent in how we use Personal Data and Users have the right to know exactly what information is held about them and how it is processed.

 

California Residents:

If you are a California resident, California Civil Code Section 1798.83 permits you to request free of charge information regarding the disclosure of your personal information by us to third parties for the third parties’ direct marketing purposes. To make such a request, send an email to [email protected].  Inventalator will not share Personal Data with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your Personal Data to third parties for their direct marketing purposes by withholding consent.

 

G. Personal Data Rights for Certain Users

There are state and international laws which provide their residents and citizens with additional rights regarding our use of their Personal Data. This section is to discuss those rights and your options to exercise such rights if they apply to you.

Users in the European Union, California, Colorado, Connecticut, Virginia, and Utah each are provided with the general rights to:

 

  1. Right to Access: Right to request Ideawake for copies of their Personal Data. Ideawake may charge you a small fee for this service. For Users residing in California, this right also includes the ability to request all Personal Data Inventalator has obtained relating to the User in the 12 months prior to the request and to have information on who the information was shared with and how it was shared, if at all.
  2. Right to Rectification: Right to request that Ideawake correct any information in our possession or control which they believe is inaccurate. This also includes the right to request that Ideawake complete any information in our possession or control which they believe is incomplete.
  3. Right to Erasure: Right to request that Ideawake erase their Personal Data, under certain conditions.
  4. Right to Restrict or Object to Processing: Right to request that Ideawake restrict and/or object to the processing of their Personal Data for targeted advertising and sales, under certain conditions.
  5. Right to Object to Profiling: Right to opt-out of any profiling through the processing of Personal Data being performed and to opt-out of any profiling being shared or sold to third parties. 
  6. Right to Data Portability: Users in the European Union (or locations where the General Data Protection Regulation is enforced) have the right to request that Ideawake transfer their Personal Data to another organization or directly to the particular European User, under certain conditions.

 

To make a request to exercise any of the above rights, the User must submit the request in writing to [email protected] or 1245 N. Water Street, Suite 200, Milwaukee, WI 53202. While we aim to provide prompt responses to all requests, Ideawake will t respond within forty-five (45) days from the initial request.

 

H. Minor’s Use/Children’s Online Privacy Protection

Protecting the privacy of children is especially important to us. For that reason, we do not knowingly process or otherwise collect, store, or disseminate the information of minors under the age of 18. Our Site and Software is not meant to attract individuals under the age of 18 and should not be accessed by anyone under the age of 18 at any time. No one under the age of 18 may provide any information to us or the Site.

 

If we learn we have collected or received information from a child under the age of 18, without verification of parental consent, we will delete that information. Inventalator doesn’t own or control these Third-Party Services. Through your interaction with such Third-Party Services, you may be providing information directly to the Third-Party Service, Inventalator, or both. These Third-Party Services are required to have their own privacy and data collection policies. We encourage you to review those privacy policies.

 

While we encourage our business partners to adopt privacy policies and practices that build users’ trust and confidence in the Internet, we are not responsible for the privacy policies or practices of third parties or any of the content of web sites linked to the Site or any third-party products or services offered through the Site.

 

J. Changes to Our Privacy Policy

Ideawake keeps its privacy policy under regular review and places updates on this web page. We reserve the right to update this Privacy Policy from time to time by publishing a new version directly to the Site. We may notify you of any such changes by email or by posting a notification on the Site’s home page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect.
